1. ORGANIZER

1.1. The organizer of the competition is the company Vasky trade sro, ID number 04779207, with its registered office at Lhota 279, ZIP code 763 02, entered in the Commercial Register kept by the Regional Court in Brno, section C, file 91852 (hereinafter referred to as the "Organizer").

2. COMPETITION

2.1. For the purposes of these Rules, the competition means the competition entitled "COMPETITION FOR WISHES" organized by the Organizer (hereinafter referred to as the "Competition").
2.2. The competition lasts from 17. 12. 2024 to 19. 12. 2024 until 12:00.

3. CONDITIONS OF PARTICIPATION

3.1. Only a natural person who meets all of the following conditions (hereinafter referred to as the "Contestant") may participate in the Competition:
3.1.1. has reached the age of 15 (FIFTEEN) years at the latest on the day of participation in the Competition, [whereas if she is under 18 (eighteen) years of age, she has obtained the prior written consent of her legal guardian in accordance with the rules set out in the legal system, at least to the extent of such consent with her participation in the Competition]
3.1.2. has a delivery address in the Czech or Slovak Republic;
3.1.3. as of the date of his/her participation in the Competition in accordance with these Rules, he/she is not in an employment or other similar relationship with the Organizer and/or is not a person close to these persons within the meaning of Section 22 of Act No. 89/2012 Coll., the Civil Code, as amended (hereinafter referred to as the "Civil Code").
3.2. A Competitor may be excluded from participation in the Competition by the decision of the Organizer if, in connection with his/her participation in the Competition:
3.2.1. in any way damages the Organizer or third parties and/or violates or threatens the rights and legally protected interests of the Organizer or third parties; and/or
3.2.2. acts in violation of applicable laws or good morals and/or violates, circumvents or abuses these Rules.

4. PARTICIPATION IN THE COMPETITION

4.1. The contestant can participate in the Competition on the Botas brand Facebook page (facebook.com/Botascz/).
4.2. The contestant may only participate in the Competition once and 1 winner will be selected on Facebook.
4.3. By participating in the Competition, the Competitor confirms knowledge of these Rules, unreservedly agrees with their wording, submits to them and undertakes to respect them.

5. COMPETITION METHOD

5.1. How to get involved?
5.1.1. By 19. 12. 2024 at 12:00, add a comment to the competition post according to the instructions in the description of the competition post, like the competition post and share it on Facebook. Follow Botas Facebook page.

6. PRIZE AND METHOD OF DETERMINING WINNERS

6.1. The prize for the Competition is a product of the winner's choice. It can be Botas shoes, Botas clothing, or Botas accessories.
6.2. The winner of the Competition will be selected by drawing lots.
6.3. The organizer will determine the winner of the Competition in accordance with the terms of these Rules and will announce it within a week of the end of the competition, via a comment on the competition post on their Facebook account. The winner will also be contacted via private message.
6.4. The Winners of the Competition are obliged to contact the Organizer based on the invitation pursuant to the previous point 6.3. of these Rules no later than five (5) business days. If the Winner does not send the Organizer contact details for sending the prize within the specified period from the Organizer's invitation or if the Organizer fails to deliver the prize, the prize will be forfeited in favor of the Organizer.
6.5. There is no legal claim to the provision of the prize. The prize cannot be enforced by legal means or alternatively paid in money or other values. Neither the contestants nor the winners are entitled to compensation for costs associated with participation in the competition or to any other payments from the Organizer.
6.6. The winner acknowledges that the prize may have tax implications for him/her, and that the acceptance and use of the prize may be subject to obligations under applicable legal regulations.

7. RIGHTS AND OBLIGATIONS OF THE ORGANIZER

7.1. The Organizer reserves the right to interrupt, shorten, extend, terminate the Competition at any time or unilaterally change or amend these Rules, even without giving a reason, with effect from the moment of publication of the new version of the Competition rules.
7.2. The Competition Organizer is entitled to further use the information (comments) sent at any time.
7.3. The Organizer is not responsible for any damage or loss of the prize when it is sent to the winner of the Competition via a postal service operator or otherwise.
7.4. The Organizer does not bear any risks and liabilities related to the use of the prize provided by a third party. The winner may exercise any claims arising from liability for defects directly with the manufacturer specified in the warranty conditions.
7.5. The Organizer is not responsible for any technical or telecommunications difficulties or defects arising during the Competition, for the speed of the technical connection or other possible shortcomings arising in connection with the Competition or in connection with electronic communications networks, or with their availability for the Competitors, nor for damage and loss to the equipment of the Competitors or other persons in connection with their participation in the Competition or with obtaining materials within the framework of the Competition.
7.6. Any objections or complaints filed by Contestants in connection with the Competition shall be decided by the Organizer. Contestants are entitled to send objections or complaints to the Organizer's e-mail no later than three (3) calendar days from the date of publication of the Competition winners. The objection or complaint must be delivered to the Organizer within the specified period. Late objections or complaints shall not be taken into account. The Organizer shall decide on the objection or complaint within ten (10) days of its delivery to the Organizer and shall inform the Contestant of its decision in the same manner in which it received the objection or complaint. The Organizer's decision on the objection or complaint is final.
7.7. The Organizer is entitled to check at any time during the duration of the Competition that all conditions for the Competitor's participation in the Competition have been met.
7.8. The Organizer is entitled to exclude from the Competition Contestants who have participated in the Competition and whose participation:
7.8.1. does not correspond to the specified topic of the Competition;
7.8.2. does not comply with the requirements set out in points 4.1. and 5.1. of these Rules (except for those which, according to the express wording of these Rules, are only of a recommendatory nature);
7.8.3. is inappropriate in terms of content, or for any other reasonable reasons as determined by the Organizer;
7.8.4. contains elements of violence or pornographic elements, or is otherwise contrary to good morals or generally binding legal regulations;
7.8.5. is capable of damaging the good name, business name, trademark of the Organizer or a third party; or
7.8.6. is otherwise in conflict with these Rules.
7.9. In the event that a person who does not meet all the requirements for a Contestant participates in the Competition or if a Contestant participates in the Competition with a Proposal that the Organizer is entitled to exclude from the Competition, and wins the Competition or meets the conditions for winning a prize in accordance with these Rules, the prize will not be awarded to him/her or handed over, without any compensation to such person. In such a case, the prize will be awarded to another Contestant drawn in the Competition who always meets all the conditions set out in these Rules and whose Proposal is fully in accordance with these Rules. Alternatively, the procedure for determining the winner will be repeated until a winner is determined who meets and whose Proposal meets all the conditions set out in these Rules.

8. PROTECTION OF PERSONAL DATA

8.1. By participating in the Competition, the Contestant agrees that, in the event of his/her winning, the Organizer will publish his/her first and last name, or nickname, and a link to his/her social network account in connection with information about the prize won by the Contestant.
8.2. The Competition Organizer is also the controller of the personal data of the Competitors who participate in the Competition and for this purpose provide their personal data that is necessary for participation in the Competition.
8.3. The Organizer, as the personal data controller, processes the personal data of the Contestants for the purpose of implementing and evaluating the Competition, handing over the prizes to the winners, and fulfilling the obligations set out in generally binding legal regulations, for the period strictly necessary to fulfil these purposes.
8.4. The Organizer processes the personal data of the Contestants to the extent that they were provided to it for the purposes of implementing the Competition. It processes in particular the name, surname and e-mail address of the Contestants, or the nickname provided on the social network FACEBOOK or INSTAGRAM, a link to their account on the social network, and the provided delivery address.
8.5. In connection with the processing of personal data, Contestants have the right, in particular:
8.5.1. withdraw consent where it is the legal basis for the processing of personal data; and
8.5.2. to object to the processing of personal data when the legal basis for the processing of personal data is the legitimate interest of the Organizer or a third party; and
8.5.3. to access, i.e. the right to obtain confirmation of whether and what personal data the Organizer processes about the Contestant, including the right to copies of the personal data it processes; and
8.5.4. to correct and supplement the processed personal data if the Competitor discovers that the personal data processed by the Organizer are inaccurate or incomplete; and
8.5.5. to deletion in certain cases, i.e. the right to contact the Organizer with a request to delete his/her personal data that is being processed. This right does not apply to the Contestant if the processing of the Contestant's personal data is necessary; and
8.5.6. to restrict processing in certain cases, e.g. in the event that the Competitor questions the accuracy, legality or need of the Organizer to process the Competitor's personal data, the Competitor has the right to request the Organizer to restrict the processing of his/her personal data.
8.7. The Competitor may exercise rights and complaints regarding the processing of personal data with the Organizer via the email address: info@botas.cz.

9. FINAL PROVISIONS

9.1. The Competition organized by the Organizer is in no way organized, supported, sponsored, administered, connected with, or affiliated with the social networks FACEBOOK and INSTAGRAM or their operators, and the operators of these social networks bear no responsibility for the Competition and its course.
9.2. The Contestant acknowledges and agrees that the Competition is fully organized by the Organizer and also provides the Organizer with all information provided in connection with participation in the Competition. The Competition is in no way associated with Meta Platforms, Inc., Facebook Ireland Ltd or Instagram LLC or any subsidiary of the aforementioned companies or operating the social networks FACEBOOK and INSTAGRAM. With this in mind, each Contestant, by participating in the Competition according to the terms of this Competition, confirms that he/she fully and completely releases the operators of the social networks FACEBOOK and INSTAGRAM from all and any obligations or liabilities of the operators of the social networks FACEBOOK and INSTAGRAM arising in connection with the organization of the Competition.
9.3. Contestants acknowledge that winnings in the Competition are not legally enforceable pursuant to Section 2874 of the Civil Code.
9.4. The Organizer will always publish the complete, valid and effective text of the Competition rules in a manner that allows remote access. Alternatively, also on the social networks FACEBOOK and INSTAGRAM.
9.5. The rules and legal relationships arising in connection with the Competition are governed by the law of the Czech Republic, to the maximum extent possible without the application of conflict of laws rules or international treaties on the basis of which a law other than the law of the Czech Republic should be applied, even in part. The decision-making and resolution of disputes related to this Competition and the participation of the Competitors and other persons in the Competition are, to the maximum extent possible, exclusively the jurisdiction of the general courts of the Czech Republic, which will decide on disputes in accordance with the substantive and procedural law of the Czech Republic.
